Introduction

This Privacy Policy describes how adaptiveX Consulting, LLC ("we," "us," or "our"), a professional consulting firm specializing in Microsoft Dynamics solutions, collects, uses, and protects your personal information. We are committed to handling your information transparently, responsibly, and in compliance with applicable privacy laws, including those of the United States and the European Union.

By engaging with our services or providing us with your information, you acknowledge and agree to the practices described in this policy.

1. What Information We Collect

To provide our consulting services effectively, we collect only the information that is reasonably necessary. This includes:

  • Full Name: To address you properly and maintain accurate records.
  • Business Email Address: To communicate with you regarding your project, proposals, and follow-ups.
  • Job Title: To understand your role and level of authority within your organization.
  • Company Name: To identify your organization and tailor our consulting approach accordingly.
  • Business Needs & Requirements: Including your goals, challenges, constraints, risks, and any other context you share with us to help define the scope of services.

We do not collect sensitive personal information such as financial account numbers, government-issued identification, health information, or any data unrelated to the business consulting engagement.

2. Why We Collect Your Information

The information we collect is used exclusively to deliver professional consulting services. Specifically, we use your information to:

  • Understand your organization's business requirements and the reasons you engaged our services.
  • Identify what you are trying to achieve through your Microsoft Dynamics implementation or optimization.
  • Evaluate the relevant factors, constraints, risks, and considerations necessary to develop viable and appropriate solutions.
  • Communicate with you about our findings, recommendations, proposals, and project progress.
  • Fulfill our obligations as your consulting service provider.

We do not use your information for marketing to third parties, profiling, automated decision-making, or any purpose beyond the scope of your consulting engagement.

3. Data Sharing & Third Parties

We do not sell, rent, trade, or share your personal information with any third party, vendor, platform, or system — without your explicit, prior written approval.

The only exceptions where disclosure may be required without your prior consent are:

  • When required by applicable law, court order, or governmental authority.
  • To protect the legal rights, safety, or property of adaptiveX Consulting LLC or others, where required by law.

If at any point we determine that using a third-party tool or platform would benefit your project, we will notify you and request your explicit written consent before doing so.

4. Your Privacy Rights

We respect and honor your privacy rights under applicable U.S. state laws (including the California Consumer Privacy Act/CCPA) and the European Union's General Data Protection Regulation (GDPR). Regardless of your location, we extend the following rights to all individuals:

Right to Access

You may request a copy of the personal information we hold about you at any time. We will respond within 30 days of receiving a verifiable request.

Right to Correction

If any information we hold about you is inaccurate or incomplete, you have the right to request that we correct it.

Right to Deletion

You may request that we delete your personal information. We will honor such requests unless we are legally required to retain the data (e.g., for tax or legal compliance purposes).

Right to Restrict Processing

You may request that we limit how we use your data, for example, if you contest its accuracy or object to how it is being processed.

Right to Data Portability (EU/GDPR)

If you are located in the EU or EEA, you may request that we provide your personal data in a structured, commonly used, and machine-readable format.

Right to Withdraw Consent

Where our processing of your data is based on your consent, you have the right to withdraw that consent at any time. Withdrawing consent does not affect the lawfulness of processing carried out prior to withdrawal.

Right to Lodge a Complaint

If you believe your privacy rights have been violated, you have the right to lodge a complaint with your local data protection authority. EU residents may contact the relevant supervisory authority in their member state.

5. Data Retention

We retain your personal information only for as long as is reasonably necessary to fulfill the purposes described in this policy, or as required by applicable law. Once the consulting engagement concludes and there is no legal obligation to retain data, we will securely delete or anonymize your information upon your request or within a reasonable period.

6. Data Security

We take reasonable and appropriate technical and organizational measures to protect your personal information from unauthorized access, loss, misuse, or disclosure. While no method of transmission or storage is 100% secure, we are committed to using commercially reasonable safeguards and will notify you promptly in the event of a data breach that affects your information.

7. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or applicable law. When we make material changes, we will notify you by email or other direct communication. The “Last Updated” date at the top of this document will always reflect when the most recent changes were made.
